Infinitum Concrete LLC provides concrete contracting services including but not limited to foundation pouring, decorative concrete installation, driveway construction, patio and walkway design, concrete repair, and commercial flatwork. Specific services, scope, pricing, and timelines will be defined in individual service agreements or project proposals. 4. Estimates and Pricing
All estimates provided by Infinitum Concrete LLC are valid for 30 days from the date of issuance unless otherwise stated. Estimates are based on information available at the time of assessment and may be revised if site conditions, material costs, or project scope change. Final pricing will be confirmed in a written service agreement before work commences. We reserve the right to adjust pricing to reflect changes in material costs, labor rates, or regulatory requirements that occur between estimate issuance and project start.
5. Payment Terms
- A deposit of up to 50% of the total project cost may be required before work begins, as specified in the service agreement
- Progress payments may be scheduled for projects exceeding two weeks in duration
- Final payment is due upon project completion unless different terms are agreed in writing
- We accept payment by check, bank transfer, and major credit cards
- Late payments are subject to a finance charge of 1.5% per month on the outstanding balance
- We reserve the right to file a mechanics lien on the property for unpaid amounts as permitted by Utah law
6. Scheduling and Delays
Project start dates and timelines are estimates based on current scheduling and weather conditions. Infinitum Concrete LLC is not liable for delays caused by weather, material shortages, permit delays, subcontractor availability, or other circumstances beyond our reasonable control. We will communicate promptly about any schedule changes and work to minimize disruption to your timeline.
7. Client Responsibilities
Clients engaging our services agree to:
- Provide accurate information about the project site, access requirements, and design preferences
- Ensure clear access to the work area on scheduled work days
- Obtain any necessary HOA approvals or permits unless otherwise agreed
- Mark or communicate the location of underground utilities before excavation work
- Secure pets and keep children away from active work zones
- Notify us of any known site hazards, environmental concerns, or structural issues
8. Warranties
Infinitum Concrete LLC warrants its workmanship for a period of 10 years from project completion against defects in installation when concrete is used as specified and maintained according to our care guidelines. This warranty does not cover:
- Damage caused by misuse, abuse, or unauthorized modifications
- Normal wear, color variation, or surface patina development
- Damage from freeze-thaw cycles beyond design specifications
- Settlement or movement of underlying soils not addressed in our engineering
- Damage from application of de-icing chemicals not approved by us
- Issues arising from failure to follow our maintenance recommendations
Concrete material warranties are provided by the manufacturer and passed through to the client to the extent permitted.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Infinitum Concrete LLC total liability for any claims arising out of or related to our services shall not exceed the total amount paid by the client for the specific project giving rise to the claim. We shall not be liable for indirect, incidental, consequential, special, or punitive damages, including loss of use, loss of profits, or business interruption, even if advised of the possibility of such damages.
Important Notice: Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability. In these jurisdictions, our liability is limited to the fullest extent permitted by law. Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
10. Intellectual Property

14. Mechanics Lien Rights
Infinitum Concrete LLC reserves all rights under the Utah Mechanics Lien Act (Utah Code Title 38, Chapter 1a) to secure payment for labor, materials, and services provided. Failure to pay amounts due may result in the filing of a mechanics lien against the property where work was performed. We will provide all preliminary notices required by Utah law before commencing work.
15. Cancellation and Refunds
- Projects may be cancelled by the client at least 7 business days before the scheduled start date
- Cancellations within 7 business days of the start date may forfeit the deposit to cover material orders and scheduling costs
- If work has commenced, the client is responsible for payment for all work completed and materials ordered to date
- We reserve the right to cancel a project if site conditions differ materially from what was represented, with a refund of any unearned deposit
16. Website Use
You agree to use our website only for lawful purposes and in a manner that does not infringe on the rights of others. Prohibited activities include:

- Submitting false or misleading information through our forms

23. Insurance
Infinitum Concrete LLC maintains general liability insurance, workers compensation insurance, and commercial auto insurance as required by Utah law. Certificate of insurance will be provided upon request before project commencement. Our insurance coverage is primary and non-contributory.
24. Site Conditions and Access
The client warrants that the project site is free of hazardous materials unless disclosed in writing. We reserve the right to stop work and renegotiate terms if we encounter undisclosed hazardous materials, unstable soil conditions, or other circumstances that affect safety or project feasibility. Additional costs arising from undisclosed conditions are the responsibility of the client.
25. Permits and Compliance
Unless otherwise specified in the service agreement, the client is responsible for obtaining necessary building permits and ensuring compliance with local zoning requirements. Infinitum Concrete LLC will perform all work in accordance with applicable building codes, including the International Building Code as adopted by the State of Utah.
26. Color and Finish Variations
Concrete is a natural product subject to color, texture, and finish variations. Minor color differences between samples and finished work are normal and do not constitute defects. Stamped patterns may vary slightly from layout to layout. We will discuss expected variations during the planning phase and provide samples when possible.
27. Maintenance Requirements
To maintain warranty coverage, clients must follow our published maintenance guidelines, including periodic sealing, avoiding prohibited de-icing chemicals, and maintaining proper drainage. Failure to follow maintenance guidelines may void warranty coverage for related issues.
28. Assignment
The client may not assign or transfer rights under a service agreement without our prior written consent. We may assign our rights and obligations to a successor entity in connection with a business transfer or restructuring, with notice to the client.
29. Waiver
Failure to enforce any provision of these terms does not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by an authorized representative of Infinitum Concrete LLC to be effective.
30. Headings
Section headings in these Terms of Service are for convenience only and do not affect the interpretation of any provision. The language in these terms shall be interpreted as to its fair meaning and not strictly for or against either party.
31. Electronic Communications

34. Cumulative Remedies
The rights and remedies of Infinitum Concrete LLC under these Terms of Service are cumulative and are in addition to, and not in substitution for, any other rights and remedies available at law or in equity.
35. No Third-Party Beneficiaries
These Terms of Service are for the benefit of Infinitum Concrete LLC and the client only. They do not create any rights enforceable by any third party. No person or entity other than the parties to this agreement may bring any action to enforce its terms.
36. Construction and Interpretation
These Terms of Service shall be construed according to their plain meaning without presumption in favor of or against either party. If any ambiguity exists, it shall not be resolved by assuming one party drafted the language. Both parties have had the opportunity to review these terms and seek legal advice.
37. Notice Requirements
All notices required under these Terms of Service must be in writing. Notices to Infinitum Concrete LLC should be sent to service@infinitumconcrete.lat or by mail to our business address. Notices to the client will be sent to the email or physical address provided during engagement. Notices are deemed received when sent by email or 3 business days after mailing.
38. Utah Contractor Licensing
Infinitum Concrete LLC operates in compliance with Utah contractor licensing requirements under Utah Code Title 58, Chapter 55. Our license status can be verified through the Utah Division of Occupational and Professional Licensing. We maintain all licenses required to perform concrete contracting work in Washington County and surrounding jurisdictions.
39. Safety Standards
All work performed by Infinitum Concrete LLC complies with OSHA safety standards and industry best practices. Our crews are trained in concrete safety, including silica dust exposure prevention, proper lifting techniques, and equipment operation. We maintain a written safety program and conduct regular job site safety briefings.
40. Environmental Compliance
We are committed to environmentally responsible concrete practices. Our operations comply with EPA regulations regarding concrete washout, stormwater management, and waste disposal. 41. Storage of Client Property
Materials and equipment staged at the project site are the responsibility of Infinitum Concrete LLC. However, we are not liable for damage to client property caused by normal construction activities unless due to our negligence. Clients should remove valuable or fragile items from the work area before project commencement.
